These Terms of Service (“Terms”) govern your use of the ActivHauling website and services. By accessing or using our services, you agree to be bound by these Terms.

1. Services Provided

ActivHauling provides truck dispatch, back-office support, compliance assistance, and related administrative services. We act solely as a service provider and do not operate trucks, employ drivers, or take possession of freight.

2. No Guarantee of Revenue or Loads

ActivHauling does not guarantee:

• Profitability
• Specific load volume
• Rates or revenue amounts
• Broker availability

Results may vary based on market conditions, equipment, carrier authority, compliance status, and other external factors.

3. Independent Contractor Relationship

Clients are independent contractors. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between ActivHauling and the client.

4. Client Responsibilities

Clients are responsible for maintaining:

• Valid operating authority
• Insurance coverage
• Compliance with FMCSA and DOT regulations
• Accurate and truthful information

5. Payments & Billing

Fees are charged only for agreed-upon services. Payments are processed securely via Stripe. Failure to pay may result in service suspension.

6. Chargebacks & Disputes

Unauthorized chargebacks may result in immediate termination of services. Clients must attempt to resolve billing disputes directly with ActivHauling before initiating a chargeback.

7. Termination

Either party may terminate services at any time unless otherwise stated in a written agreement. Outstanding balances remain payable upon termination.

8. Limitation of Liability

ActivHauling shall not be liable for indirect, incidental, or consequential damages including loss of income, business interruption, or regulatory penalties.

9. Indemnification

Clients agree to indemnify and hold harmless ActivHauling from any claims, fines, losses, or liabilities arising from the client’s operations, compliance failures, or misrepresentations.

10. Website Use

Users agree not to misuse the website, attempt unauthorized access, or disrupt services. We reserve the right to restrict access if misuse occurs.

11. Changes to Terms

ActivHauling reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of revised Terms.

12. Governing Law

These Terms are governed by the laws of the United States and the State in which ActivTruckin LLC is registered.
